Introduction:
NATURALS CARE (hereinafter referred to as "the Organization") is committed to providing a safe and respectful work environment for all its employees, volunteers, clients, and stakeholders. This policy aims to prevent and address instances of sexual harassment in the workplace. The Organization is committed to maintaining a zero-tolerance approach towards sexual harassment and will take appropriate action to investigate and address any reported incidents promptly and effectively.
Policy Statement:
2.1 Definition of Sexual Harassment
Sexual harassment refers to any unwelcome sexual advance, request for sexual favors, or other verbal, non-verbal, or physical conduct of a sexual nature that interferes with an individual's work performance or creates an intimidating, hostile, or offensive work environment.
2.2 Scope
This policy applies to all employees, volunteers, clients, and stakeholders of the Organization, irrespective of their gender, position, or contractual arrangement. It covers conduct that occurs within the workplace premises, work-related events, or any other place where the Organization's activities take place.
Responsibilities:
3.1 Organization's Responsibility
The Organization is responsible for:
· Creating awareness about sexual harassment prevention and this policy.
· Ensuring prompt and impartial investigation of reported incidents.
· Taking appropriate disciplinary action against individuals found responsible for sexual harassment.
· Providing support and protection to complainants and witnesses.
3.2 Employee and Volunteer Responsibility
All employees and volunteers are responsible for:
· Treating others with respect and dignity.
· Reporting any instances of sexual harassment, they witness or experience.
· Cooperating with the investigation process.
· Maintaining confidentiality and not retaliating against complainants or witnesses.
Reporting and Complaint Procedure
4.1 Reporting
Any individual who believes they have experienced or witnessed sexual harassment should promptly report the incident to their immediate supervisor, the Human Resources Department, or any designated person responsible for receiving complaints.
4.2 Confidentiality and Non-Retaliation
All reports of sexual harassment will be handled with utmost confidentiality, except where disclosure is necessary for investigation purposes or as required by law. The Organization prohibits retaliation against individuals who make good faith reports or participate in the investigation process.
4.3 Complaint Investigation
The Organization will promptly initiate an impartial investigation upon receipt of a complaint. The investigation will be conducted with due respect for the privacy and dignity of all parties involved. The complainant, the alleged harasser, and relevant witnesses will be interviewed, and any evidence will be collected and documented.
4.4 Disciplinary Action
If the investigation substantiates a complaint of sexual harassment, appropriate disciplinary action will be taken against the harasser, ranging from warnings, retraining, transfer, suspension, or termination, as deemed necessary by the severity of the offense.
Awareness and Training:
The Organization will conduct regular awareness and training programs on sexual harassment prevention, ensuring that all employees and volunteers are aware of their rights and responsibilities under this policy. New employees and volunteers will receive specific training during their orientation.
Review and Evaluation:
This policy will be periodically reviewed to ensure its effectiveness and compliance with legal requirements. Any necessary revisions will be made to address emerging issues or concerns.
Compliance:
Failure to comply with this policy may result in disciplinary action, up to and including termination of employment or volunteer engagement, as deemed appropriate.
This policy supersedes any previous policies or guidelines on sexual harassment and remains in effect until further notice.
